INSTRUCTIONS: OHIO ENTRY APPROVING DISTRIBUTION IN KIND (Form 10.1)

The form discussed in this article is used to approve distribution in kind of as proposed by the fiduciary of an Ohio estate. This document can be obtained from the website maintained by the Ohio Supreme Court. The form will be completed by the supervising probate judge.

Ohio Entry Approving Distribution In Kind 10.1 Step 1: The judge will enter the name of the county in which the probate court administering the estate is located on the first blank line.

Ohio Entry Approving Distribution In Kind 10.1 Step 2: The judge will enter the name of the decedent whose estate is being administered on the second blank line.

Ohio Entry Approving Distribution In Kind 10.1 Step 3: The judge will enter the case number assigned to administration of the estate on the third blank line.

Ohio Entry Approving Distribution In Kind 10.1 Step 4: The judge will check the first box if they have determined that the distribution in kind as set forth in the application submitted is not prohibited by law and will be in the best interests of the estate. By checking this box, the judge is also confirming that all parties concerned have consented to the proposed distribution and order the fiduciary to be authorized to distribute the personal property in accordance with the application.

Ohio Entry Approving Distribution In Kind 10.1 Step 5: The judge will check the second box if they have determined that the distribution in kind proposed in the application submitted is not prohibited by law and will be in the best interest of the estate. By checking this box, the judge is also ordering that the fiduciary be authorized to distribute the personal property in accordance with the application.

Ohio Entry Approving Distribution In Kind 10.1 Step 6: The judge will check the third box if the judge approves the application and also needs to issue additional orders not stipulated above.

Ohio Entry Approving Distribution In Kind 10.1 Step 7: On the next blank line, the judge will enter the date.

Ohio Entry Approving Distribution In Kind 10.1 Step 8: On the last blank line, the judge will enter their signature.

Ohio Entry Approving Distribution In Kind 10.1 Step 9: The fiduciary will execute the application upon receipt of this form.
