INSTRUCTIONS: CALIFORNIA CREDITOR'S CLAIM (Form DE-172)

The form discussed in this article is filed by a California creditor as part of an estate probate case. This document can be obtained from the website maintained by the California Judicial Branch.

California Creditor's Claim DE-172 Step 1: In the first blank box, if represented by an attorney, enter their name, state bar number, address and telephone. If not represented by a lawyer, enter your name, address and telephone number.

California Creditor's Claim DE-172 Step 2: In the second blank box, enter the county in which the court is located, as well as its street address, mailing address, city, zip code and branch number.

California Creditor's Claim DE-172 Step 3: In the third blank box, enter the name of the decedent.

California Creditor's Claim DE-172 Step 4: In the fourth blank box, enter the case number.

California Creditor's Claim DE-172 Step 5: On line 1, enter the total amount of the claim.

California Creditor's Claim DE-172 Step 6: On line 2, enter the name of the claimant.

California Creditor's Claim DE-172 Step 7: Check box 2a if the claimant is an individual, box 2b if the claimant is an individual or entity doing business under a fictitious name, box 2c if a partnership, box 2d if a corporation, or box 2e if other. If the latter, specify.

California Creditor's Claim DE-172 Step 8: On line 3, enter the address of the claimant.

California Creditor's Claim DE-172 Step 9: On line 4, indicate with a check mark whether the claimant is a creditor or a person acting on behalf of a creditor. If the latter, provide an explanation.

California Creditor's Claim DE-172 Step 10: Check the box on line 5 if the claimant is either the personal representative or attorney for the personal representative. Indicate which with a check mark.

California Creditor's Claim DE-172 Step 11: On line 6, indicate with a check mark whether facts supporting your claim are attached on the reverse of the page or on an attachment.

California Creditor's Claim DE-172 Step 12: Type or print your name and title on the next blank line.

California Creditor's Claim DE-172 Step 13: Enter your signature on the next blank line.

California Creditor's Claim DE-172 Step 14: Complete the rest of the form as instructed.
