INSTRUCTIONS: GUARDIANSHIP OF MINOR PC-2.2

This form is filed with the Probate Court where the minor currently resides. Form PC-9.2 Attorney of Record should be filed with this form and filed with the estate records as well.

“Guardianship of Minor PC-2.2 Step 1”

After completing the heading of the form, provide the minor’s date of birth on the first line. Then, write the estimated value of the minor’s estate on the second line. Provide the petitioner’s relationship to the minor on the third line.

“Guardianship of Minor PC-2.2 Step 2”

In the next two sections, provide the name of the parents, their telephone number, and their address. If the parent is deceased, provide the date of the death on the appropriate line as well.

In the next section, provide the name of the proposed guardian, their telephone number, and their street address.

“Guardianship of Minor PC-2.2 Step 4”

At the bottom of the page, the petitioner needs to provide their signature.

Once the Probate Clerk has accepted the petition for filing, they will advertise the petition so any interested parties can attend a hearing. Additionally, if a surviving parent is not being nominated as guardian, they need to approve the petition or be service with a Citation.

If a parent has approved, the PC-5.1 General Citation is sent to the minor.

“Guardianship of Minor PC-2.2 Step 6”

If the guardianship is approved by the court, the judge will issue a Decree. The decree is listed on the third page of this document and lists the name, telephone number, and address of the person being appointed as guardian.

The decree lists the amount of the bond and states whether the bond is with surety or without surety.

“Guardianship of Minor PC-2.2 Step 7”

An appraiser is also appointed by the court. The name, telephone number, and address of the appraiser are listed within the decree as well.

“Guardianship of Minor PC-2.2 Step 8”

The guardian will be required to make annual reports to the court. Once the minor reaches the age of 18 or the courts finds that the minor has rights to their estate, the duties of the guardian will be ended.
