INSTRUCTIONS: NEW YORK ADMISSION c.t.a. (AFTER PROBATE) PROCEEDING CHECKLIST

The document discussed in this article is to be used as a checklist if applying to be the executor of a will in which no executor has been named or if the original executor has died, renounced or otherwise failed to serve prior to application for probate. This checklist is for your use only and is not be filed. The document can be obtained from the website maintained by the New York State Unified Court System.

New York Admission c.t.a. (After Probate) Proceeding Checklist Step 1: The top of the form instructs you to make sure the office of executor or administrator is vacant by obtaining a death certificate, proof of revocation or proof of resignation.

(After Probate) Proceeding Checklist Step 2: The next section instructs you to fill out all areas on all pages of the application petition, including marking "not applicable" when necessary. You should also check all forms to make sure the venue is correct and the appropriate county is listed.
