INSTRUCTIONS: PETITION FOR GUARDIANSHIP OF MINOR WITH HEARING PACKET

This form need filed with the District Court where the ward currently resides. There are multiple forms in this packet, and instructions are provided for all forms below:

“Petition for Guardianship of Minor with Hearing Packet Step 1”

After completing the heading of the form, the petitioner needs to record all of the minor’s real and personal property. While recording the value of items, make sure the items do not appear in the Appraised Inventory section. Items should only be listed once within the packet.

“Petition for Guardianship of Minor with Hearing Packet Step 2”

After listing all of the minor’s real and personal property, the guardian must sign the Verified Record of Value form. If there is a co-guardian, the person must sign as well. Include the total value of the inventory in the paragraph.

“Petition for Guardianship of Minor with Hearing Packet Step 3”

After the guardians have accounted for all real property and personal property, an appraiser must evaluate the property as well. If there is any real or personal property that was not accounted for, the appraiser must list these items, their value, the value of the ward’s interest in the item, and more.

After completing the appraisal, the appraiser must sign and complete the Oath of Appraiser, CPA or Expert in Valuations and Appraisal forms. The appraiser must provide the date of the appraisal and sign the form in front of Notary Public.

The guardian and co-guardian must also complete an Oath stating that the property and values they provided are correct and complete to the best of their knowledge. The guardian affirms that the record of inventory and appraisal are true of his or her knowledge. These forms need notarized.

Apart from the Oaths, the guardian and co-guardian must also complete a Verification form. The form simply provides that all of the information in these forms is true of the guardian’s knowledge. The form needs signed and notarized.

The guardian(s) need to make copies of all the forms and submit the forms along with the filing fees to the Clerk.
