INSTRUCTIONS: PETITION FOR APPOINTMENT OF GUARDIAN AND CONSERVATOR (Minor) GAC 5-UM

This form needs filed with the Probate Court in the District the minor currently resides. Follow these instructions carefully, and ask the Clerk of Court what other forms and fees you need.

“Petition for Appointment of Guardian and Conservator (Minor) GAC 5-UM Step 1”

In parts 1, 2, and 3, provide all necessary information for the petitioner, the respondent (the minor), and the spouse or kindred of the minor. If the minor is not married, provide information for an adult the minor has lived with for at least 6 months.

If there is an administrator, legal representative, or another prior guardian or conservator, provides their contact information in sections c, d, and/or e. If you fill out section e, make sure to attach the prior order, healthcare directive or similar document.

Part 5 is particularly important. If the petitioner is asking for full guardianship, check the first box and explain why a limited guardianship is not appropriate. If a limited guardianship is necessary, check all boxes that apply from box 1 to 8.

Part 7 is also particularly important. If the petitioner is asking for a full conservatorship, check the first box and explain why a limited conservatorship is not appropriate. If a limited conservatorship is necessary, check the appropriate boxes.

Parts 8 and 9 apply to the minor’s assets and debts. Provide values for homestead, other real estate, money, investments, personal property, and other property. Provide an approximate value of the ward’s debt.

Part 11 is simple to fill out and only asked for the name, age, and address of the guardian and conservator. Check the appropriate box to indicate how the guardian and conservator were nominated.

In part 12, fill out the appropriate boxes and provide a signature and date of signature. The petitioner needs to provide the name of their attorney, their license number, and their address.
