INSTRUCTIONS: PETITION FOR APPOINTMENT OF GUARDIAN OF MINOR MPC140

This form along with all other required forms must be submitted to the Probate and Family Court in the division the minor currently resides in.

“Petition for Appointment of Guardian of Minor MPC140 Step 1”

After completing the heading of the form, parts 1, 2 and 3 are simple to fill out and require information about the minor and the petitioner. The minor may choose to file a petition, or another interested party may file a petition.

In part 4, provide all necessary information for the legal parent’s of the minor. If they are deceased, check the box on the right.

In part 5, state whether there is a willful nomination or other writing and attach a copy of the document if so.

Part 15 lists any assets the minor may have in their name like bank accounts, property, anticipated income, social security, etc.
