INSTRUCTIONS: PETITION FOR CHANGE OF NAME (Minor) CN-2

A legal custodian may submit the petition in the county where the minor currently resides. A divorced parent can also petition for a name change. The following documents may need submitted to the court as well:

· certified copy of minor’s birth certificate

· divorce judgment (if applicable)

· court order for custody of child

· death certificate of a deceased custodian (if applicable)

In the heading of the form, the petitioner needs to select the county of the Probate Court and the minor’s current, full legal name. If an attorney is helping with the petition, provide their information as well. The Clerk will provide the docket number.

“Petition for Change of Name (Minor) CN-2 Step 2”

In part 1, provide full legal names for all the petitioner(s) and the legal custodian(s) of the child. In part 2, provide addresses and telephone numbers for all of the people listed in part 1. If a physical address is different from a mailing address, provide the additional address as well.

In part 3, check all of the documents that need submitted along with the petition.

Provide the current name of the minor child, including the middle name. In part 5, provide the address where the minor currently resides.

In part 6, state the desired name change for the minor. Include a middle name if applicable.

In part 7, state reasons for the request. The petitioners need to date and sign the form. If they’re receiving help form an attorney, an additional signature is needed as well.

When submitting the petition, Form N-103, General Notice of Beginning of a Formal Probate Proceeding with a Hearing Date is required as well. You can obtain this form from the Clerk. If notice is waived, Form N-107 is required.

Make copies of all the forms and file them with the Clerk along with filing fees. The Clerk will notify the petitioner(s) of the date, time, and location of the hearing.
