INSTRUCTIONS: PETITION FOR GUARDIAN OF MINOR 39A

There is no statewide form used for guardianship for a minor because each Circuit Court has their own forms. These instructions apply to the 12th Judicial Circuit in Will County, but apply nonetheless to most petitions throughout the state.

“Petition for Guardian of Minor 39A Step 1”

In part 1, provide the petitioner’s full legal name, the minor’s full legal name, and the date of birth and address for the minor.

“Petition for Guardian of Minor 39A Step 2”

In part 2, provide the approximate value of the minor’s personal estate, real estate, and the anticipated income.

“Petition for Guardian of Minor 39A Step 3”

In part 3, list the full legal name of the person with custody at this moment, along with the person’s address.

“Petition for Guardian of Minor 39A Step 4”

In part 4, list the full legal name of the mother and father along with their last known address. If the mother and father are deceased, list other relatives such as siblings, grandparents, or aunts and uncles.

In part 5, the petitioner needs to check all boxes that apply. Then provide appropriate names and dates for the first four options. In the last two options, provide specific reasons why the mother or father cannot provide proper care.

In part 6, a guardian will have to check the first box if they want approval from a judge. A convicted felon will not be elected as guardian.

In the last part of the petition, list the proposed guardian’s full name, address, age, and relationship to the child. The petitioner must provide a signature along with their address and information for the attorney or person that helped with the petition.

“Petition for Guardian of Minor 39A Step 8”

The Nomination is for a minor who is at least 14 years of age. If the minor agrees to the guardianship, they will have to provide the full legal name of the proposed guardian and their address. The minor has to sign the document and date when the signature was placed.
