INSTRUCTIONS: GUARDIANSHIP MINOR PERSON (Pro-Se Packet) 1FC-G

There are five different forms provided in this packet for the guardianship of a minor:

· Petition for the Appointment of a Guardian of a Minor

· Notice of Hearing

· List of Exhibits

· Waiver of Notice and Consent to Guardianship

· Order Appointing Guardian with Limited or Unlimited Authority

“Guardianship Minor Person (Pro-Se Packet) 1FC-G Step 1”

If you’re attaching forms to the packet, type in the information on the form and delete all of the phrases within the parentheses. All information must be typed in black, 12 point pica size print. All of the documents need signed in legible and dark ink.

The case name and number needs placed on all documents as well. Place the petitioner’s name, address, and phone number in the upper left-hand corner of the first page of each document.

“Guardianship Minor Person (Pro-Se Packet) 1FC-G Step 2”

Each person requiring notice needs a copy of each original document. All documents need filed with the Legal Documents Branch at the Kapolei Court Complex, 4675 Kapolei Parkway. Any changes made to the original documents need “conformed,” meaning that all forms are identical to the original document.

“Guardianship Minor Person (Pro-Se Packet) 1FC-G Step 3”

After filing your documents with the Receiving Clerk, you need to pay $175.00 in filing fees by cashier’s check, money order, or cash. Make the checks payable to the “Chief Clerk, First Circuit Court.”

“Guardianship Minor Person (Pro-Se Packet) 1FC-G Step 4”

Copies of the Petition and Notice of Hearing need served to all persons listed under HRS §§560:5-205:5-113. The copies must be sent at least 14 days before the hearing by first class mail to the following parties:

· the minor who is 14 years or older

· any person who was the minor’s custodian for 60 days before the filing of the petition

· the legal mother and father

· the adult of nearest kinship to the mother and father if either the mother or father is deceased

· each adult sibling of the minor if both parents are deceased

· any current guardian of the minor

· Any appointee of a parent under HRS §560:5-203

One of the following is required after mailing notice:

· written proof of notice

· signed waiver

· a statement attaching the Post Office receipt

· sworn statement
