INSTRUCTIONS: PETITION FOR CHANGE OF NAME (Minor Child(ren)) FL 12.982(c)
This form is used when parents want to change the name of their minor children. The form should not be used in dissolution of marriage, paternity, or adoption. The name change will be part of the case.
This form needs completed in black ink and must by notarized. Submit the form in the Circuit Court where the family currently resides.

If there is more than one petitioner or the name of more than one child is being changed, a Supplementary Form for Petition is required for each name change and each petitioner.

Each adult petitioner needs to have the fingerprints scanned by an approved Law Enforcement Department unless they are restoring the child’s former name. A hearing cannot be requested until the clerk receives results for the state and national criminal history records check. Ask the clerk for more information on the fingerprints process.

If both of the parents agree to the change of name, they can both file as petitioners. Service is not required if both parents agree. Personal service or Constructive Service is necessary if either parent fails to consent to the change of name. Refer to Forms 12.910(a) and 12.913(b) for more information.

After the forms are filed with the clerk, a final hearing can occur immediately if restoring a former name as long as the results of the state and national criminal history check are received. Otherwise, the clerk will provide the petitioner(s) with a date, time, and location of the hearing.

Bring the Final Judgment of Change of Name (Minor Child(ren)) to the hearing and complete the top section of the form. If the judge approves the change of name, they will sign the Order. You can receive certified copies of the Order from the clerk.
