INSTRUCTIONS: SOUTH DAKOTA FINANCIAL AFFIDAVIT (Form UJS-304)
When filing a petition for divorce against your spouse in South Dakota, you must submit a financial affidavit detailing your fiscal circumstances in order to help the court rule on issues of alimony, child support, attorney's fees and other costs. This Form UJS-304 can be obtained from the website of the South Dakota Unified Judicial System.
South Dakota Financial Affidavit UJS-304 Step 1: At the top of the first page, write the number of the judicial district you are appearing in and the county.
South Dakota Financial Affidavit UJS-304 Step 2: The first section requires personal information. Provide your full name, address, telephone number, indicate your employment status, list your weekly take-home pay and the total value of your benefits, your total income before deductions, and how many dependants you have.
South Dakota Financial Affidavit UJS-304 Step 3: Section one requires you to list all assets, include cash, money owed to you, investments such as stocks and bonds, real estate, motor vehicles, household goods, miscellaneous personal property and any other assets that could be sold for money. Total the value of these assets.
South Dakota Financial Affidavit UJS-304 Step 4: Section two concerns liabilities. Enter your total monthly expenses and all debts you owe. Include the name of your creditors. Total this amount.
South Dakota Financial Affidavit UJS-304 Step 5: In section three, enter any income you are expecting to obtain from any source.
South Dakota Financial Affidavit UJS-304 Step 6: Sign and date the form in the presence of a clerk of courts or notary public.
South Dakota Financial Affidavit UJS-304 Step 7: One copy of this form will be filed with the clerk of courts. The other must be served upon your spouse.
