INSTRUCTIONS: PETITION FOR APPOINTMENT OF GUARDIAN FOR MINOR (JDF 824)

“Petition for Appointment of Guardian for Minor JDF 824 Step 1”
The petitioner needs to complete all applicable sections and sign the form in the presence of the Court Clerk or Notary Public.
If the child’s father is not known, a copy of the birth certificate needs attached to the petition. If the parental rights have been terminated or the parents are deceased, copies of the termination papers or the death certificates need attached to the Petition.

File all the documents with the court. There will be a $127.00 filing fee. Copies of all documents are required for all of the following:
· Primary caretaker of the minor 60 days before filing the petition
· Each parent living with the minor, or nearest adult kinship

· Appointee of a parent
· Any guardian acting for the minor in or out of state

Send notice to the parents or other interested persons by mail or by publication.

Send Notice of Hearing to the minor if they are 12 years of age or older. Ask the sheriff’s department for guidelines. After notification, file Notice of Hearing to Respondent JDF 807 with the completed Personal Service Affidavit.

Attend the hearing and be ready to present any necessary evidence. If the minor cannot attend the hearing, the petitioner needs to file a Motion to Excuse the Minor and provide appropriate documentation like a physician’s letter.
