The Vermont
Affidavit for
Child Custody is the form required for Vermont residents seeking custody of their children through the court. This affidavit must be filed in order to obtain a
court order for child custody in the state of Vermont.
The Vermont Affidavit for Child
Custody can be obtained by searching online or through the state court.
This form is to be used for requesting custody or visitation.
1. First you must fill out the case caption information at the top of the form. Include the court name, docket number, and the names of the parties involved.
2. You must next state your name as the party filing the petition.
3. Next, indicate in part 1 whether you are the plaintiff or defendant named in the matter.
4. Select whether you are the father, mother, or have another relationship with the children for whom custody is to be determined.
5. In part 3, you must list where each child has resided over the last 5 years. Provide the addresses and names of household members who lived with the children. If you need more space, you may attach an additional sheet to the petition.
6. Provide the current address of all household members named in part 3.
7. In part 3b, select the answers that best describe prior
cases that have involved you, the other party, and the children. Select yes or no if prior or current cases have occurred. If you know of another person who is not a named party but has a claim of custody, you must indicate so in question iii.
8. Sign and date the form at the bottom of the petition. You must also have a notary sign and certify the petition before it is complete. You must provide a copy to all other named parties before submitting the petition to the court.
