INSTRUCTIONS : IDAHO CHILD CUSTODY PETITION (Form CAO 13-3)
The Idaho Petition for
Child Custody is the form required for Idaho residents seeking custody of their children through the court. This petition must be filed in order to obtain a
court order for child custody in the state of Idaho.
The Idaho Petition for Child
Custody can be obtained by searching online or through the state court.
This form is to be used for seeking an order of child custody in which both parties agree. If the custody is contested, a different form must be used.
1. First, fill out the names and contact information for both the father and mother of the children at the top of the form.
2. Next, fill out the case caption information at the top of the form, putting in the court name, the name of the parties, the case number and the fee information.
3. In part 1, list the names of the children whom custody is to be order, providing their date of birth and residence for the past 5 years.
4. In part 2, you must acknowledge that the state of Idaho can legally establish
paternity to the children. You must state the name of the biological father in this section or state whether the father is filing a Verified Voluntary Acknowledgment of Paternity.
5. Provide the current residence of both the mother and the father.
6. For part 5, state whether you or another parent has acted as a party or
witness in another case involving the children. If yes, you must state the nature of the case and provide this information on the provided lines.
7. State whether you are seeking joint legal custody and that both parents are fit to care for the children or if
sole custody should be awarded. If sole custody is sought, you must provide an explanation.
8. In part 7, state whether you are seeking joint or sole physical custody of the children and provide an explanation why you believe the court should allow it. You may attach a
Parenting Plan to the form, which will outline your agreed upon custody plan in detail.
9. State whether
child support is to be sought and the amounts that should be awarded. You must provide a breakdown of what child support should be provided.
10. Continue through the form stating the support that is needed for medical expenses, work related child care costs, and
income tax credit allowance.
11. Finally, each parent must sign and date the bottom of the petition, with a notary present for each parent's signature.
