INSTRUCTIONS: CALIFORNIA SUMMONS (Form DE-125)

The form discussed in this article is issued to people who may be affected by the probate of a California estate. This document can be found on the website maintained by the California Judicial Branch.

California Summons DE-125 Step 1: Where indicated, enter the name of the person to whom the summons is being issued, the name of the person issuing the summons and the name of the person whose estate is concerned.

California Summons DE-125 Step 2: Below, enter the name and address of the court.

California Summons DE-125 Step 3: Where indicated, enter the case number.

California Summons DE-125 Step 4: Where indicated, enter the name, address and telephone number of the filing party's attorney or the same information for a party not represented by an attorney.

California Summons DE-125 Step 5: The deputy will sign and date the form where indicated.

California Summons DE-125 Step 6: Check the box on line a if the person is being served as an individual.

California Summons DE-125 Step 7: Check the box on line b if the person is being served on behalf of a corporation, defunct corporation, association or partnership, minor, conservatee or other. Indicate which with a check mark.

California Summons DE-125 Step 8: Check the box on line c if the person is being served by personal delivery and enter the date on which this occurred.

California Summons DE-125 Step 9: The second page should be completed by the person who served the summons. At the top of the page, enter the name of the decedent and the case number.

California Summons DE-125 Step 10: On line 1, enter the documents being served.

California Summons DE-125 Step 11: On line 2a, enter the name of the party being served.

California Summons DE-125 Step 12: Check the first box on line 2b if the person being served was the person named on line 2a. If other, check the second box and enter the name and title or relationship to the party named on line 2a.

California Summons DE-125 Step 13: On line 2c, enter the name of the person being served.

California Summons DE-125 Step 14: Indicate how the party was served by checking the applicable statements on lines 3a through 3e.

California Summons DE-125 Step 15: Complete the rest of the form as instructed.
