INSTRUCTIONS: CALIFORNIA CAPACITY DECLARATION — CONSERVATORSHIP (Form GC-335)
The form discussed in this article is completed by a physician, psychologist or religious healing practitioner to enable a California court to determine whether a conservatee or proposed conservatee is able to attend a court hearing to determine whether a conservator should be appointed, if they have the capacity to give informed consent to treatment, or if they have dementia. This form can be obtained from the website maintained by the California Judicial Branch.
California Capacity Declaration — Conservatorship GC-335 Step 1: The first part of the form should be completed by person filing the petition concerning conservatorship. In the first box at the top of the page, enter the name of your attorney, their state bar number, address, telephone party and the name of the represented attorney. If you do not have an attorney, provide your name, address and telephone number instead. In both cases, providing an email address and fax number is optional.
California Capacity Declaration — Conservatorship GC-335 Step 2: In the second box, enter the county in which the court is located, as well as its street address, mailing address, city and zip code and branch name.
