INSTRUCTIONS: ARKANSAS EMANCIPATION PACKET

“Emancipation Packet Step 1”

You need to qualify for emancipation in the first place. There are three ways to get emancipated:

1. You have permission your parents and the court to get married.

2. You joined the military and have the approval of your parents.

3. Have the court approve a declaration of emancipation after meeting the following qualifications:

· You are at least 17

· You don’t live with your parents

· Your parents approve of your moving out

· You have a legal way to make your own money

· Emancipation is in your best interest

The following numbers and descriptions correlate with the order they appear on the petition:

1. The county where you live

2. Your legal name

3. Your age

4. The case number that is assigned by the Circuit clerk’s office

5. Your legal name

6. The county where you live

7. Your parent’s names; if married both have to sign; if one or both parents are not involved your legal guardian must sign; if parents have joint legal custody both must sign; if deceased write “None”

8. Your signature and address

“Emancipation Packet Verification Step 3”

9. County where the Notary Public is signing the verification

10. Your legal name

11. Sign your name and the notary public will fill out the rest

“Emancipation Packet Waiver and Consent to Petition Step 4”

12. The county where you live

13. Your legal name

14. Your age

15. Your legal name

16. Name and address of legal guardian

17. County where the Notary Public is signing

18. Your legal name

19. Name and signature of parents and the notary will fill out the rest (two copies are needed if both parents have joint legal custody)

20. The county where you live

21. Your legal name

22. Your age

23. The county where you live

“Emancipation Packet Step 6”

The judge will complete the rest of the order. You will need to bring a money order for court filing fees which are currently $140.00 as of 2012. Ask for the phone number of the judge’s case coordinator. Once the emancipation is granted, ask for a copy from the Circuit Clerk’s office.
