INSTRUCTIONS: PETITION TO CHANGE CHILD’S NAME CIV-694

At the top of the form, write the city where your court is located. Use the current legal name of the child on the “Minor Child” line. The same applies for the petitioner. The rest of the form is simple to fill out.

“Petition to Change Child’s Name CIV-694 Step 1”

The non-petitioning parent needs to fill out Form CIV-695 and sign the form in front of notary public. If the other parent refuses to fill out the form, the petitioner parent will have to send a Summons and additional forms. Ask the clerk for more information.

“Petition to Change Child’s Name CIV-694 Step 2”

Fill out Form VS-405 as well and complete lines 1 through 8b. The clerk will fill out the rest of the form.

Make copies of the forms, file the originals with the local clerk, and pay the $150 filing fee. If you cannot afford the fee, you will have to fill out Form TF-920.

The clerk will give you an Order for Hearing (CIV-701). If the clerk states that you have to publish notice of the name change, they will provide you with specific instructions for before and after the hearing.

During the hearing, the judge will make sure the non-petitioning parent approved the measure of the proper documents were submitted at least 30 days before the hearing if there was not consent. If the child is old enough, the judge will ask for their opinion.

Within 20 days after the hearing, the petitioning party must provide the clerk with proof of publication. Then, the clerk will issue the Certificate of Name Change (CIV-705). The certificate will state when the child can start using their new name.

After the child’s name is changed, it is important to change other record as well. Depending on the child’s age, the following forms will have to be changed:

· social security card

· driver’s license

· birth certificate

· school, bank, insurance records and more
